These Terms of Use ("Terms") govern access to and use of ClockIT (the "Service"). By creating an account, inviting staff, or using the Service, you agree to these Terms.
If you use ClockIT on behalf of a business, you confirm that you have authority to bind that business to these Terms. In that case, "you" includes the organisation.
These Terms are a practical operating agreement for an early-stage product. They are not a substitute for legal advice tailored to your business.
1. The Service
ClockIT provides tools for organisations to manage staff profiles, availability, rosters, attendance clock-in and clock-out, replacement requests, and related labour summaries. Features may change as we improve the product. Some capabilities described on marketing pages may be limited or unavailable in your environment.
2. Accounts and access
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding credentials for admin and staff accounts under your control.
- Organisation administrators are responsible for inviting the correct people, setting store access, and reviewing attendance exceptions such as non-rostered punches before relying on payroll summaries.
- We may suspend or terminate access if we reasonably believe the Service is being abused, compromised, or used unlawfully.
3. Your data and responsibilities
- You retain ownership of the business and workforce content you submit to ClockIT (rosters, staff records, attendance notes, and similar material).
- You grant us a limited licence to host, process, and display that content solely to operate and improve the Service.
- You are responsible for having a lawful basis to upload staff personal information and for your compliance with workplace and privacy laws that apply to your organisation.
- You must not upload unlawful content, attempt to access another organisation's data, reverse engineer the Service except as allowed by law, or disrupt the Service.

4. Acceptable use
You agree not to:
- Use the Service for illegal activity or to harass individuals
- Share accounts in a way that bypasses role or store controls
- Probe, scan, or overload the Service without permission
- Misrepresent your identity when inviting staff or issuing clock credentials
5. Third-party services
The Service depends on third-party infrastructure (for example hosting, database, and email). Outages or changes at those providers can affect availability. We will take commercially reasonable steps to keep the Service reliable, but we do not guarantee uninterrupted access.
6. Intellectual property
ClockIT branding, software, and documentation remain our property (or our licensors' property). These Terms do not transfer ownership of the software to you. You may not copy, resell, or redistribute the Service except as expressly allowed.
7. Disclaimers
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. ClockIT helps prepare labour and attendance information, but it does not replace professional payroll, accounting, tax, or employment advice. You remain responsible for verifying totals, reviewing exceptions, and meeting your payroll and employment obligations.
8. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us for the Service in the three months before the claim, or (b) one hundred Australian dollars (AUD 100) if you are on a free or unpaid plan. Nothing in these Terms excludes liability that cannot be excluded by law.
9. Termination
You may stop using the Service at any time. We may suspend or end access if you materially breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including ownership, disclaimers, and liability limits) continue to apply.
10. Changes to the Terms
We may update these Terms as the product evolves. The "Last updated" date on this page will change when we publish revisions. If you continue using the Service after changes take effect, you accept the updated Terms where permitted by law. If you do not agree, stop using the Service.
